For many H-2B programs, the process involves several government stages, including:
Filing windows are fixed. Employers can file for labor certification within a set window, typically 75 to 90 days before the start date. Get ready before the filing window opens, so you can submit your application on time.
The annual cap creates competition. The statutory cap for H-2B visas is 66,000 per year, with up to 33,000 available in each half of the fiscal year. Demand is usually far higher. In the January 2026 filing period, the Department of Labor received 10,062 applications requesting more than 162,000 positions. USCIS then reached the cap for the second half of the fiscal year, and March 10, 2026 was the last day it accepted new cap-subject petitions for start dates between April 1 and September 30.
Supplemental visas can help, but they are difficult to plan around as they aren't guaranteed. The additional FY 2026 visas were authorized for one fiscal year only, so there is no guarantee of the same relief in 2027.
A delay at one stage pushes back every stage after it. A late start leaves little room to recover from a request for more information or a scheduling backlog.
For an April 1, 2027 start date, the H-2B labor certification filing window opens in January 2027.
That may feel early. But a clear timeline turns a complex, multi-agency process into a manageable plan with defined milestones.
