This employer checklist will keep you on track.
Confirm the role requires less than two years of training
Submit ETA Form 9141 to obtain Prevailing Wage Determination from the Department of Labor.
Obtain a PERM Labor Certification by filing ETA Form 9089, proving no U.S. workers are available.
Gather candidates’ documents, such as degrees, experience letters, etc.
File Form-I-140 with USCIS
Optional: request Premium Processing for an extra fee
Once Form I-140 is approved, the process moves to the worker, who waits for their Priority Date to apply for their green card
International candidate receives approval and visa.
Schedule travel and in-country arrangements.
Comply with the Department of Labor audits.
Inform USCIS of changes in job duties, location, or employment status.
Maintain immigration documentation and proof of compliance
Prevailing Wage Determination: two - three months
PERM Certification: six - 18 months
Form I-140: eight - 13 months (15 days with Premium Processing)
Priority Date: varies depending on government backlog
Adjustment of Status/Consular Processing: 11-30 months
